Please read these terms carefully before using Clutch.

These Terms of Service ("Terms") govern your use of the Clutch mobile application and related services (collectively, the "Service") provided by Clutch Ltd ("we", "us", or "our"). By using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

Acceptance of Terms

  • By accessing and using Clutch, you accept and agree to be bound by these Terms of Service
  • If you do not agree to these terms, you must not use our service
  • You must be at least 17 years old to use Clutch
  • You must have a valid provisional or full driving license
  • You are responsible for maintaining the confidentiality of your account

Use of Service

  • Clutch is an educational tool to supplement professional driving instruction
  • The app does not replace the need for qualified driving instruction
  • You must comply with all applicable traffic laws and regulations
  • You must not use the app in a way that distracts from safe driving
  • You are responsible for mounting your device safely and legally

Prohibited Uses

  • Using the service for any illegal or unauthorized purpose
  • Attempting to reverse engineer or hack the application
  • Sharing your account with others or using multiple accounts
  • Using the app while driving without a qualified supervisor when required
  • Misrepresenting your driving experience or qualifications

Liability and Disclaimers

  • Clutch is provided "as is" without warranties of any kind
  • We are not liable for any accidents or incidents while using the app
  • The app's feedback is educational and not a guarantee of driving safety
  • We do not guarantee passing your driving test
  • You use the service at your own risk and discretion

Payment Terms

  • Subscription fees are billed monthly in advance
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • Failure to pay may result in suspension of your account
  • You can cancel your subscription at any time

Intellectual Property

  • All content in Clutch is owned by us or our licensors
  • You may not copy, modify, or distribute our content
  • You grant us a license to use any feedback you provide
  • Your driving data remains your property
  • We may use anonymized data for research and improvement

Indemnification

You agree to defend, indemnify, and hold harmless Clutch Ltd, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

Limitation of Liability

In no event shall Clutch Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Your Agreement

By using Clutch, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
